The Committee received and noted the Minutes of the meeting of the Licensing Subcommittee held on 23 November 2018.

ENFORCEMENT POLICY FOR ENVIRONMENTAL HEALTH, PRIVATE SECTOR HOUSING, LICENSING & CLEANSING pdf icon PDF 67 KB

The report seeks approval for the Council to adopt amendments to the existing Enforcement Policy for Environmental Health, Private Sector Housing, Licensing & Cleansing, which includes two additional enforcement options that can be considered, i.e. Service of a Community Protection Warning & Community Protection Notice and a Civil Penalty for Housing Act 2004 offences.

 

In addition, the report seeks approval to set a fine of a maximum of £100 for service of a fixed penalty notice as an alternative to prosecution for breach of a Community Protection Order.

The Committee had been circulated with this report from the Group Head of Technical Services prior to the meeting.  However, due to a misunderstanding, the tracked changed draft Policy had not been attached to the report included in the agenda but had been circulated via emal to all Members.  A view was expressed that the Policy should therefore not be considered at this meeting but should be deferred to enable Members to fully consider the proposed changes.

 

            Without the Group Head of Technical Services being asked to present the report, and having been formally proposed and seconded, the Committee

 

RESOLVED

 

That the matter be deferred to the next meeting.
