Exempt Information The Committee is asked to consider passing the following resolution: -
That under Section 100a (4) of the Local Government Act 1972, the public and accredited representatives of newspapers be excluded from the meeting for the following item of business on the grounds that they involve the likely disclosure of exempt information as defined in Part 1 of Schedule 12A of the Act by virtue of the paragraph specified against the item. Minutes: The recommendation to enter into exempt business was proposed by Councillor Haywood and seconded by Councillor Kelly.

Review of a Hackney Carriage/Private Hire Dual Driver Licence - Exempt - Paragraph 1 of Part 1 of Schedule 12A of the Local Government Act 1972 To consider the attached report. Additional documents:

The Sub-Committee received a report from the Licensing Officer which set out the detail of a review of a hackney carriage/private hire driver licence for a driver who had obtained recent convictions and not declared them.
Following the Council’s procedure for Licensing Sub-Committees, detailed representations were heard from the relevant parties in attendance. This was followed by questions from the Sub-Committee and other parties present, which were responded to at the meeting. The reviewee explained that he had suffered a bereavement and other personal difficulties at the time, and the reason for failing to notify the Council of his motoring conviction was an honest mistake due to administrative errors on his part.
The Licensing Officer and reviewee were invited to respond to any points of clarification they required.
The reviewee was invited to sum up his case and he confirmed he had said all that he wished to.
The panel then retired to consider its decision.
The meeting was then reconvened and the Chair advised that the Sub-Committee had taken into account all the representations made before them, both written and oral in respect of this matter, and also had due regard to the Statutory Guidance, the Council’s own Licensing Policy and licensing objectives. The decision of the Sub-Committee was then delivered to all present. The Chair emphasised that administration was an important part of the reviewee’s job, and the Sub-Committee urged him to pay it due regard in the future.

RESOLVED to
1. Issue a written warning that the hackney carriage/private hire licence holder may have their licence revoked if they appear before the Licensing Sub-Committee within the next 12 months.
2. Add 6 penalty points that expire on 23 March 2026.
